Terms and Conditions of Use of the Site
Acceptance Statement:
By accessing the site, the User expresses their knowledge and acceptance of these Terms of Use. These, along with any subsequent modifications, take effect immediately upon publication on the Site. Use of the Site implies the User's full acknowledgment and acceptance of these Terms of Use. In case of disagreement with the Terms or any changes to them, the User must refrain from continuing to use the Site.
Nature of the Service and Purpose of the Site:
The Site has been developed as a virtual space for Users to access the products of Grupo Nucleo's store from the comfort of their homes. The Services are intended for individuals with legal capacity to contract. Individuals without such capacity, minors, or those registering a legal entity as a User, who must have the capacity to contract on behalf of that entity and bind it according to the terms of these Terms of Use, will not be able to use the Services.
Use of the Services:
The User, whether registered or "guest," assures that the information provided when submitting the registration request will be accurate, correct, and up-to-date. They commit to immediately and reliably inform of any changes, being completely responsible to Grupo Nucleo for any damages arising from the breach of this obligation, including, but not limited to, costs related to the User's physical location, costs of notifications and summons, among others. The User agrees to use the Services solely for the purposes established in (a) the Terms of Use and (b) any applicable laws or regulations, whether municipal, provincial, or national, including, but not limited to, laws, decrees, ordinances, resolutions, directives, etc. Additionally, the User agrees not to disclose their password to unauthorized third parties to access the Services of the Site.
Scope of Application
These Terms of Use govern all sales of products and/or services made by Grupo Nucleo in the Argentine Republic. Placing an order implies the User's express acceptance of these Terms of Use. By registering or logging in as a "guest," the User declares under oath and certifies that they are 18 years of age or older. If they do not agree (or cannot comply) with any of the rules of the Terms of Use, they are urged not to use the Site. The information provided when operating on the Site must be accurate and truthful. Providing inaccurate or false information constitutes a serious violation of these Terms of Use. By confirming their order upon completing the transaction, the User accepts the purchased items and commits to pay their price, establishing a sales contract for merchandise with Grupo Nucleo.
References to Third Parties
References on the Site to names, brands, products, or services of third parties, as well as hyperlinks to third-party websites or information, are provided solely as a convenience to the User. In no event do they constitute or imply endorsement, sponsorship, or recommendation by Grupo Nucleo regarding the third party, its information, products, or services. Grupo Nucleo does not control the practices or policies of those third parties or the content of third-party websites, and makes no representations or warranties regarding third-party products or services, or regarding the content or accuracy of any material hosted on those third-party sites. If the User decides to navigate or follow a link to any of those third-party websites, they do so entirely at their own risk and responsibility.
Purchase Order Corresponding to Each Order
The User must place their order in the same way they fill their cart in our stores, virtually browsing the aisles and selecting the merchandise they wish to purchase, indicating the desired quantity for each item. The Site's procedure allows adding or removing items from the order, completely canceling it, and reviewing it. There may be minimum or maximum quantities, volumes, or prices for items included in a purchase order. All prices published on the site are exclusive for online purchases of the products and may differ from or be identical to the prices published in the other branches as applicable.
Acceptance of Orders
It is important to note that, after the User approves a purchase, Grupo Nucleo may not be in a position to accept it in full or in part. For various reasons, some items in the order may be canceled or excluded, such as limitations on available quantities, merchandise shortages, lack of authorization from the credit card issuing entity, inaccuracies in products or information, or issues identified by the credit and pricing fraud prevention department. To ensure your security, we may require additional information or conduct checks before accepting any order. If part or all of the order is canceled, or additional information is needed, we will contact you. In all cases of modification or partial cancellation of the order, the User has the right to cancel the order in its entirety. We reserve the right to definitively cancel any operation after verifying the entered data, and the User will be notified in the event of such a decision. Purchases are subject to the reported stock; due to delays in system updates, it is possible to allow a purchase that must later be canceled due to lack of stock. In that case, the User will be informed by email.
Delivery and Payment Method
Once the order is confirmed and the invoice amount is approved, unless there are exceptional issues accepting the order, Grupo Nucleo will send an email within 24 hours confirming the successful processing of the order. The User will receive this email at the address indicated in their registration or order. The confirmation will detail the order number and delivery details (dates, costs, among other specifications). If the User wishes to change the delivery method or date, they must contact customer service. Grupo Nucleo offers various payment methods (credit/debit cards, bank transfers, cash, etc.) that will be informed in advance during the order process. These will depend on the nature of the items purchased and/or promotional campaigns available at that time. Payments made through online payment services are subject to their terms and conditions. Grupo Nucleo is not responsible for issues related to these services. For any purchase, Grupo Nucleo will issue the corresponding invoice that the User can download from the Site or receive at the delivery address indicated in the order.
Special Offers
Promotions, discounts, and special offers may apply to certain products, defined in each case in their respective sections. Grupo Nucleo reserves the right to modify or remove these promotions without prior notice. Discounts are applicable only when the conditions outlined in the corresponding campaign are met.
User Responsibility
The User is responsible for any damages that Grupo Nucleo may incur as a result of the breach of any of the obligations imposed on them in these Terms of Use. Any operation that results from the User’s incorrect use of the Site is solely their responsibility. Grupo Nucleo will not be liable for any damages caused by errors, mistakes, or omissions in the information provided by the User.
Privacy Policy
Grupo Nucleo is committed to protecting the privacy of its Users. The collection of personal information is limited to that necessary for the provision of the Services. The information will be treated confidentially and will not be disclosed to third parties, except as required by law. Grupo Nucleo will implement the necessary technical and organizational measures to ensure the security of the data provided by the User, preventing its alteration, loss, unauthorized treatment, or access. The User may exercise their rights of access, rectification, cancellation, and opposition regarding their personal data, contacting Grupo Nucleo via the channels provided on the Site.
General Provisions
These Terms of Use constitute the entire agreement between the User and Grupo Nucleo regarding the Site and its Services. If any provision of these Terms is declared invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected or impaired in any way. The User acknowledges that Grupo Nucleo may assign or transfer its rights and obligations under these Terms, at its sole discretion. Failure to exercise or delay in exercising any right or provision of these Terms does not constitute a waiver of such right or provision.
Jurisdiction and Governing Law
These Terms of Use are governed by the laws of the Argentine Republic. Any dispute arising from the interpretation or execution of these Terms will be submitted to the jurisdiction of the competent courts of the Autonomous City of Buenos Aires, renouncing any other jurisdiction that may correspond. Violations of system or network security may result in civil or criminal liability. Grupo Nucleo will investigate incidents related to such violations and may cooperate with authorities to prosecute the involved users. The use of devices, software, or routines to interfere with the proper functioning of the Site is prohibited. Furthermore, the User agrees not to use any device or software to interfere with the functioning of the Site, and not to employ engines, software, tools, agents, or other devices for browsing that are not provided by Grupo Nucleo. The User and/or occasional browser of the Site expressly acknowledge that any action affecting the security and normal development of the Site may cause significant damage to Grupo Nucleo, including loss of sales, damage to brands and commercial image, and loss of clientele.
Passwords and User Account Security:
By accepting the Terms of Use, the User acknowledges that they are solely responsible for maintaining the confidentiality of their password. Consequently, they assume exclusive responsibility to Grupo Nucleo for all activities conducted in their account on the Site. The User must immediately notify Grupo Nucleo of any unauthorized use of their password or account. This notification must be made through the Site and by sending written communication to the address of Grupo Nucleo, providing complete details regarding the unauthorized use of the password.
Personal Data
By registering as a User on this Site, you will provide information that, at the discretion of Grupo Nucleo, is necessary to provide optimal service. The User's personal data is collected for the purpose of fulfilling Grupo Nucleo's business operations, carrying out marketing and advertising actions. By deciding to provide your data, the User expressly consents that Grupo Nucleo may use it for operational purposes of the e-commerce system on this Site and/or on other websites of Grupo Nucleo, as well as to send offers, promotions, or advertisements by various means. By providing your personal data through registration on the Site, you give consent as required by Argentine law No. 25.236, including the possibility of transfer established in its art. 11, which you may revoke at any time by making a request via email or other easily verifiable means. The Site is committed to maintaining a strict privacy policy and protecting the data generated by the online activity of its users, without disclosing personal information to third parties. Grupo Nucleo is authorized to analyze information from its users as a group and, based on such analysis, offer goods and services individually or in conjunction with third parties. It is allowed to share depersonalized information related to users with third parties. The holder of personal data has the right to access it free of charge at intervals no less than six months, unless a legitimate interest is proven in accordance with article 14, section 3 of Law No. 25.326. Grupo Nucleo advises its customers to keep their data updated to receive personalized offers and promotions. The National Directorate for the Protection of Personal Data, the Control Body of Law No. 25.326, handles complaints and claims related to the breach of personal data protection rules.
Prices
Although Grupo Nucleo strives to provide accurate information about product prices on the Site, errors may occur. In the event that an item is listed at an incorrect price due to an error, Grupo Nucleo has the right to correct the order by billing the current price at the time of assembling the order in the store or to cancel the order by refunding the amounts paid to the User. The User will be notified of the error, giving them the option to cancel or modify the purchase.
Promotions
Promotions on the Site may differ from those offered on other sales channels of Grupo Nucleo. The specific conditions of each promotion will be detailed on the Site or in the corresponding advertising. In promotions that include free or discounted delivery of a product upon the purchase of another, delivery will be made to the same location as the purchased product. Unless otherwise indicated or approved by Grupo Nucleo, promotions are not cumulative.
Descriptions and Images of Goods
Grupo Nucleo strives to be accurate in product descriptions, but these may not be exact or may contain errors. In the event of a discrepancy between the advertised image and the purchased product, the User has the right to cancel the order up to 15 days after delivery, provided there are no prior observations from the User. If the order is canceled due to inaccuracies in the description or images, the User must return the product in perfect condition, with its original packaging and accessories. Information regarding product characteristics is obtained from claims made by the manufacturer, and Grupo Nucleo is not responsible for any changes in packaging and labels. It is recommended to read the labels, warnings, and instructions before acquiring or consuming a product. For additional information, it is suggested to contact the manufacturer, distributor, or importer.
Advertising
Grupo Nucleo reserves the right to include advertisements on the Site, clearly identifying them to distinguish them from information regarding the description and price of the items offered. These ads are intended to highlight specific offers and do not replace the product descriptions on the Site.
Quantity Limits and Sales to Distributors
Grupo Nucleo may limit the quantity of items purchased per order when justified reasons exist. These restrictions may apply to orders made with the same account, credit card, billing address, and/or delivery address.
Copyright and Trademarks
Copyrights, trademarks, trade dress, and/or other intellectual property rights over all content on the Site are owned, controlled, or licensed by Grupo Nucleo, protected by Argentine laws and international treaties on intellectual property. The compilation of all content is exclusive to Grupo Nucleo and is also protected by the aforementioned laws and treaties. Grupo Nucleo and/or its suppliers grant the User a limited, non-exclusive license to access the Site and use its content for personal purposes only. It is expressly prohibited to copy, modify, distribute, republish, display, transmit, or exploit the Site's content for commercial purposes or without the express consent of Grupo Nucleo.
Applicable Law and Jurisdiction
These Terms of Use and the relationship between the User and Grupo Nucleo are governed by the laws of the Argentine Republic. Any dispute arising in relation to these Terms of Use will be subject to the exclusive jurisdiction of the courts of the City of Buenos Aires.
Acceptance of Terms
The User declares to have read, understood, and accepted these Terms of Use. Grupo Nucleo reserves the right to modify these Terms of Use without prior notice, and such modifications will be effective as soon as they are posted on the Site. Therefore, it is the User's responsibility to review them regularly.
